These Terms of Service (“Terms”) govern your use of the Castillo Serrallés Audio Tour mobile application (“the App”) provided by Museo Castillo Serrallés (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms.
1. The Service
The App is a self-guided audio tour for the Castillo Serrallés museum in Ponce, Puerto Rico. It provides audio narration, photographs, and information about the rooms and artifacts of the museum. Content is delivered to your device on demand from our servers.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes consistent with these Terms. You may not:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App for any unlawful, fraudulent, or harmful purpose
- Resell, rent, or sublicense the App
- Remove or alter any copyright or proprietary notices
- Use automated means to access or scrape content from the App
3. Intellectual Property
All content in the App — including text, images, audio recordings, photographs, design elements, and the Castillo Serrallés name and logo — is the property of Museo Castillo Serrallés or its licensors, and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
4. QR Codes and In-Museum Use
The App is designed to be used while visiting the Castillo Serrallés museum. QR codes placed inside the museum are intended solely to unlock the corresponding audio content within the App. Please be respectful of other visitors and follow all on-site rules and guidance from museum staff.
5. Camera Access
The App requests permission to use your device’s camera only to scan QR codes within the museum. The camera is not used for any other purpose, and no images are stored or transmitted. You may revoke this permission at any time through your device’s settings.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which explains what information the App handles and how.
7. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or always available, that defects will be corrected, or that the audio, photographs, or text are free of inaccuracies. The App may rely on third-party services (such as content hosting and audio playback) whose availability we do not control.
8. Limitation of Liability
To the maximum extent permitted by law, Museo Castillo Serrallés will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the App. Our total liability for any claim relating to the App shall not exceed five U.S. dollars ($5.00).
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be reflected in a new App Store release. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
10. Termination
We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. The intellectual-property and liability provisions of these Terms will survive any termination.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the courts located in Ponce, Puerto Rico.
